1 Our position as a service provider
Salacious lets accounts save links to pages elsewhere on the internet and, for a supported set of video platforms, display that page's own embedded player directly on a bookmark's page. Salacious does not store a copy of the linked or embedded file itself โ only the link, and (for preview purposes) metadata the destination page already publishes about itself.
Because of that, a takedown of the actual copyrighted file needs to go to whoever hosts it โ the destination site, or the video platform behind an embed. What this policy covers is narrower but still real: removing or disabling the specific bookmark, link, or embed on Salacious that points at infringing material, on receipt of a valid notice.
2 Filing a valid takedown notice
To be actionable under 17 U.S.C. ยง512(c)(3), a notice must include:
- A physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing, and information reasonably sufficient for us to locate it on Salacious โ the specific bookmark's URL (e.g.
https://your-domain/bookmark/123) is the fastest way. - Your contact information โ address, telephone number, and email address.
- A statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the above is accurate and that you're authorized to act on the copyright owner's behalf.
Send it to the contact in section 6. An incomplete notice may take longer to act on while we ask for the missing piece.
3 What happens after we receive one
On receiving a complete notice, we'll remove or disable the specific bookmark, link, or embed identified, notify the account that saved it, and keep a record of the notice. We may act on a notice that's substantially complete even before every formality is verified, where leaving the material up in the meantime seems like the greater risk โ but a notice missing the elements in section 2 may need to be resubmitted before we can act.
4 Counter-notification
If your bookmark was removed and you believe that was a mistake or misidentification, you can send a counter-notice under 17 U.S.C. ยง512(g) including your contact information, identification of the material and where it appeared before removal, a statement made under penalty of perjury that you have a good-faith belief it was removed by mistake, and your consent to the jurisdiction of the federal court for your district (or, if outside the U.S., any district where Salacious may be found).
We'll forward a valid counter-notice to the original complainant. Unless they notify us they've filed a court action seeking to restrain you, we may restore the material in 10โ14 business days.
5 Repeat infringers
Salacious will, in appropriate circumstances, terminate the account of anyone found to be a repeat infringer.
